BMW Motorcycle Guided Tours
Please read these Terms and Conditions carefully. By participating in the BMW Motorcycle Guided Tour, the participant accepts the General Terms and Conditions stated below.
- Operator and Guide Information
1.1. The tour operator is Sebastian Radetic Car, with NIE Z1******Q hereinafter referred to as “Tour Operator”.
1.2. The guide of the tour is Sebastian Radetic Car, hereinafter referred to as “Guide”.
- Booking, Deposits and Declaration of Valid Driving License
2.1. A booking is considered valid when the signed booking form and proof of deposit payment are submitted to Guide via the Stripe payment form.
2.2. A deposit of 20% of the total tour value is required to secure a place on the tour, which will be deducted from the total price of the tour.
2.3. Tour bookings are subject to availability and will be confirmed via email. A booking is only secured once a payment of 20% of the total tour price has been made.
2.3. Places on the tour are reserved based on the order in which applications are received.
2.4. By completing the booking, the participant declares to possess a valid driving license for the duration of the tour and for the vehicle used in the tour.
2.5. The participant must inform the Guide without delay of any and all changes regarding their driving license that affect tour participation (e.g., revocation of the driving license).
2.6. If it turns out after the booking, before, or during the tour that the participant does not have a valid driving license, the Guide is released from its obligation to continue fulfilling the contract and may invoice cancellation rates as per these terms and conditions. In such a case, the Guide reserves the right to withhold the motorcycle and exclude the participant from the tour.
- Tour Pricing and Payment Terms
3.1. The listed prices for BMW guided motorcycle tours are based on one rider using a premium BMW motorcycle based on availability.
3.2. The company cannot guarantee a specific motorcycle model, except where an additional booking fee of €50 has been paid for a specific motorcycle booking. This guarantee is subject to the availability of the requested motorcycle. Should the requested motorcycle not be available despite the additional payment made, the additional fee will be refunded in full.
3.3. If a participant wishes to ride with a pillion (passenger), a surcharge of €50 per day will be charged.
3.4. The total balance of the tour price must be paid at least 7 days before the start of the tour.
3.5. Failure to pay the balance 7 days prior may result in cancellation of the booking and forfeiture of the deposit.
- Inclusions
4.1. The rental price for the guided tour includes:
– the motorcycle rental,
– third party liability insurance,
– motorcycle helmet & gloves,
– motorcycle petrol,
– a tour guide,
– and road assistance for the duration of the tour.
- Participant Waiver and Liability
5.1. Each participant must sign a release of liability agreement before the start of the tour. Emergency contact information and insurance policy details (where applicable) must be provided to the organizer.
5.2. The Guide is not responsible for the safety of participants and cannot be held liable for injury, death, or damage during the tour. No claims shall be made against the organizer, the tour Guide, or company staff in the event of accidents or injury. The safety and participation of each individual and the group as a whole is the sole responsibility of each individual participant.
- Participant Responsibilities and Equipment
6.1. All participants are individually responsible for complying with riding laws, paying any fines incurred and adhering to security and road regulations. While the tour Guide will prioritize the safety of all participants, each rider is legally and personally responsible for their own safety and the safety of the group.
6.2. The participant must ensure that they have proper and adequate equipment, including a helmet, protective gear and other safety equipment necessary for the tour.
6.3. The participant shall follow the instructions of the Guide during the entire tour.
6.4. Any failure to comply with the Guide’s instructions may result in the exclusion of the participant from the tour.
- Health and medical Conditions
7.1. The participant confirms that they are in good physical and mental health, capable of participating in the tour.
7.2. The participant is responsible for declaring any medical conditions that may affect their ability to safely participate in the tour. This information must be shared with the tour guide or organizer prior to the tour’s commencement.
7.3. The participant assumes full responsibility for any consequences arising from their failure to declare such conditions.
7.4. In the event that a participant experiences health issues during the tour, the Guide reserves the right to take appropriate measures, including ending the participant’s participation for safety reasons.
- Cancellation and Changes by Guide
8.1 The exact route of the guided tour cannot be guaranteed and may be changed, cancelled or modified by the Guide based on weather conditions, road conditions, the experience level of the group, force majeure or other unforeseen circumstances. However, the company guarantees the tour type (full-day, multi-day, VIP) as booked.
8.2. Any additional costs resulting from such changes shall be borne by the participant.
8.3. Any changes will be communicated to the participant as soon as possible and the participant will be offered suitable alternatives if necessary.
- Travel insurance, Liability and Insurance Options
9.1. It is the participant’s responsibility to ensure they have adequate insurance coverage for the tour, including health, accident, and liability insurance.
9.2. The Guide shall not be held liable for any accidents, injuries, or damages incurred during the tour.
9.3. The participant shall indemnify the Guide against any third-party claims resulting from accidents or damages caused by the participant.
9.4. The tour operator strongly recommends that participants obtain adequate travel, health, accident, and trip cancellation insurance.
9.5. Third-party liability insurance is included for the duration of the guided tour.
9.6. Participants are strongly encouraged to purchase the additional Motorcycle Coverage Plus Insurance, which limits liability to a maximum of €1200. This insurance is available at a price of €10 per day per motorcycle.
- Motorcycles Provided by the Guide
10.1. The Guide provides motorcycles as part of the tour package. The actual motorcycle model may differ from those shown in promotional materials.
10.2. In case of unavoidable situations (e.g., technical issues, theft), the Guide reserves the right to substitute the motorcycle with a comparable model.
10.3. A security deposit of 600 Euros is required at the start of the rental period. The deposit will be returned once the undamaged motorcycle is returned.
- Motorbike Rental Conditions
11.1. The participant is responsible for any damage to the rented motorcycle caused by negligent or improper use.
11.2. In the event of damage, the participant must cover repair costs, as determined by the Guide.
11.3 The participant shall return the motorcycle in the same condition as it was provided, with all equipment intact.
- Exclusion of Participation
12.1. The Guide reserves the right to exclude customers from the tour for reasons including but not limited to:
– Lack of required equipment.
– Failure to follow instructions.
– Health concerns that arise during the tour.
– Disruptive or dangerous behaviour that compromises the safety of the group.
– Participant’s experience level, or any other visible or perceived condition that poses a potential safety risk or concern.
- Traffic Laws, Responsibilities and Riding Conduct
13.1. Participants must comply with all traffic laws.
13.2. Guide reserves the right to revoke the contract if a participant violates traffic laws or pose a danger to others.
13.3. Participants are responsible for all traffic tickets received during the tour and any damage caused to third parties.
13.4. Participants must refrain from overtaking while riding in the group.
13.5. The tour Guide will assess riding conditions during stops and will determine the riding order of participants. This decision is final and must be adhered to for the safety of the group.
- Photography and Media
14.1. Participants may choose to grant the Guide permission to use photos and videos taken during the tour for marketing purposes. If granted, no compensation will be provided for the use of such materials. However, participants can also opt out of granting this permission.
- Cancellation by Participant
15.1 Cancellation Refunds
- a) For cancellations made more than 60 days before the tour date, a full refund of the 20% booking fee will be provided.
- b) For cancellations made 7 to 59 days before the tour date, 50% of the 20% booking fee will be refunded.
- c) For cancellations made 7 days or less before the tour date, the tour organizer reserves the right to retain in full the 20% booking fees paid in advance.
- Accuracy of Information
16.1. By participating in the tour, each participant declares that all provided information is accurate and correct.
- Additional Terms
17.1. The Guide is not responsible for lost or stolen items during the tour.
17.2. The Guide is not responsible for delays in the delivery of rented motorcycles or tour interruptions due to weather or other uncontrollable conditions.
17.3. The Guide reserves the right to adjust the tour route or cancel the tour if necessary for safety reasons or due to adverse weather or other conditions.
- Jurisdiction and Applicable Law
18.1. These terms and conditions are governed by the laws of Canary Islands, Spain.
18.2. Any disputes arising from the contract or participation in the tour will be subject to the exclusive jurisdiction of the courts of Las Palmas, Gran Canaria.
